1.2 Scope

1.2.1 These T&C govern the use of the Famez.com platform ("Platform") by Fans, Creators, and Agencies.

1.2.2 By registering on the platform, users agree to these T&C.

1.2.3 Deviating terms of the users are not accepted unless Famez.com expressly agrees to them.

1.3 Contract Language and Applicable Law

The contract language is German. Croatian law applies, taking into account mandatory consumer protection regulations of the user's country of residence.

1.4 Changes to the T&C

Famez.com reserves the right to change these T&C at any time. Users will be informed of changes. If no objection is made within 14 days, the changes are considered accepted.

2. Service Description

2.1 Famez.com serves exclusively as a networking and advertising platform for Creators and Agencies.

2.2 Sales of digital or physical products, services, or subscriptions through Famez.com are prohibited.

2.3 The platform enables Creators to create a profile, connect with fans, and book advertising campaigns and monetization features.

2.4 Agencies can manage Creator profiles, place advertisements, use management tools, and offer their own services (such as management, consulting, marketing) to Creators, provided the Creator confirms the collaboration.

2.5 Famez.com provides the technical infrastructure but is not a contractual party between Creators, Agencies, and their Fans.

2.6 Use of the platform is generally free of charge but can be expanded through paid additional services.

2.7 Famez.com also provides profiles of non-verified Creators, which can be claimed free of charge by the respective Creators or deleted upon request (see DMCA procedure).

3. Registration & User Accounts

3.1 Registration is only permitted for individuals of legal age (18+).

3.2 Creators must provide: stage name, bio, engagement links, and payment options.

3.3 Agencies must provide: company details, contact persons, and registered Creators.

3.4 Each user is obliged to keep their login data confidential and not to share it with third parties.

4. Creator Profiles & Agency Management

4.1 Creators may upload their own content that complies with platform guidelines.

4.2 Creators and Agencies may not conduct sales through Famez.com. However, services may be offered under individual agreements between Agency and Creator.

4.3 Agencies may manage a Creator's profile only with the Creator's explicit consent.

4.4 Famez.com reserves the right to remove profiles or content that violate applicable law or platform guidelines without prior notice.

5. Monetization & Advertising

5.1 Creators can promote their profiles but may not conduct direct sales through the platform.

5.2 Agencies can manage Creator profiles and offer services, but only with the explicit consent of the respective Creators.

5.3 Advertisements must be reviewed and approved by Famez.com before publication.

5.4 Payments for advertisements or premium features are processed via external payment service providers.

6. Prohibition of Direct Sales

6.1 No digital or physical products, services, or subscriptions may be sold directly through Famez.com.

6.2 Creators may use Famez.com only for self-promotion, not for direct sales of content or fan services.

6.3 Agencies may not sell paid services directly to fans via Famez.com. Services for Creators under a management agreement are permitted.

6.4 Violations may result in the suspension or deletion of the user account.

7. User Responsibilities

7.1 Users are responsible for the content of their profiles and must not upload copyrighted or illegal content.

7.2 Any form of spam, deception, or illegal behavior will lead to immediate account suspension.

7.3 Agencies may not manage Creators without their consent or misrepresent them as their own clients.

8. Disclaimer of Liability

8.1 Famez.com accepts no liability for damages caused by incorrect information, technical problems, or outages.

8.2 Famez.com only provides technical infrastructure – all legal and financial agreements between Creators, Agencies, and Fans are their sole responsibility.

8.3 Famez.com is not liable for payment delays or defaults between users.

9. Term & Termination

9.1 Users may delete their account at any time without giving reasons.

9.2 Famez.com may suspend or delete accounts if users violate these T&C or applicable laws.

9.3 Refunds of fees already paid for advertisements or premium features are excluded.

10. Data Protection & Confidentiality

10.1 The data protection regulations of Famez.com apply.

10.2 Personal data is processed only within the framework of legal regulations and not passed on to unauthorized third parties.

11. Copyright & Usage Rights

11.1 All content published on the platform remains the property of the respective creator.

11.2 By uploading content, the Creator grants Famez.com a non-exclusive right to display the content on the platform.

11.3 Creators and Agencies providing media material for booked promotions agree that this material may also be used on third-party platforms, partner sites, or other marketing channels. The use is solely for promoting the respective Creators or Agencies and supporting bookings and reach expansion.

11.4 Redistribution or commercial use of the content without the author's consent is prohibited.

12. Changes to the T&C

12.1 Famez.com reserves the right to change these T&C at any time. Changes will be communicated via email or within the platform.

12.2 Continued use of the platform after a change of the T&C is deemed acceptance of the new terms.

13. Final Provisions

13.1 Should any provision of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.

13.2 The law of the Republic of Croatia applies.

13.3 The place of jurisdiction for all disputes is Split, Croatia.
