1.2 Scope
These Terms and Conditions (T&C) govern the use of the platform Famez.com (“Platform”) by creators, agencies, and fans.
By registering on the platform, users agree to these T&C in their current version.
Any deviating conditions provided by users shall not apply unless Famez.com has given express written consent.

1.3 Contract Language & Applicable Law
The contract language is German.
The applicable law is that of the Republic of Croatia.
For contracts between business entities (B2B), German consumer protection law (§§312g ff. BGB) does not apply.
Mandatory consumer protection provisions apply only if the user can prove that they are acting as a consumer (private individual).

1.4 Changes to the T&C
Famez.com reserves the right to amend these T&C at any time. Users will be notified of such changes.
If no objection is raised within 14 days, the amended terms are deemed accepted.

2. Description of Services

Famez.com is a networking and promotional platform for creators and agencies.
The sale of digital or physical products, services, or subscriptions via Famez.com is strictly prohibited.
Creators can create profiles, interact with fans, book advertising campaigns, and increase their visibility.
Agencies may manage creator profiles, place advertisements, and use management tools, provided that the creator explicitly agrees to the collaboration.
Famez.com provides only the technical infrastructure and does not act as a contractual party between creators, agencies, or fans.
Use of the platform is generally free of charge but may be extended through paid premium services.
Famez.com may display automatically generated profiles of publicly listed creators. These can be claimed or deleted at any time free of charge.

3. Registration & Accounts

Registration is permitted only for individuals aged 18 years or older.
Creators must provide information such as stage name, biography, and social/engagement links.
Agencies must provide company details, contact persons, and managed creators.
Users must keep login data confidential and may not share it with third parties.

4. Creator Profiles & Agency Management

Creators may upload their own content, provided it complies with platform guidelines.
Sales via Famez.com are prohibited.
Agencies may manage a creator’s profile only with the creator’s explicit consent.
Famez.com reserves the right to remove profiles or content without prior notice if they violate applicable law or platform policies.

5. Advertising & Promotion

Creators may promote their profiles through paid advertising.
All advertising campaigns are subject to review and approval by Famez.com before publication.
Payments are processed through external payment providers (e.g., Stripe, PayPal).
Campaigns are launched only after payment has been received.
Famez.com is entitled to use submitted media (images, texts, videos) for marketing purposes, including on partner websites, networks, or social media channels.

6. Prohibition of Direct Sales

Direct sales through Famez.com are prohibited.
Creators may use the platform solely for self-promotion.
Agencies may not sell paid services directly to fans.
Violations may result in account suspension or deletion.

7. User Obligations & Responsibilities

Users are solely responsible for the content they upload.
Spam, deception, or unlawful behavior will lead to immediate account suspension.
Agencies may only manage verified creators.

8. Disclaimer of Liability

Famez.com assumes no liability for technical malfunctions, data loss, or incorrect information provided by users.
Famez.com merely provides the platform infrastructure; all contracts between users are made independently.
Famez.com is not liable for payment delays or defaults between users.

9. Term & Termination

Users may delete their accounts at any time.
Famez.com may suspend or delete accounts that violate these T&C or applicable law.
Refunds for paid fees (e.g., advertisements, promotions, premium features) are excluded, even in the case of early termination.

10. Data Protection & Confidentiality

The Privacy Policy of Famez.com applies.
Personal data will be processed only in accordance with legal requirements (GDPR) and will not be disclosed to unauthorized third parties.

11. Copyright & Usage Rights

All uploaded content remains the property of the respective uploader.
By uploading content, creators grant Famez.com a non-exclusive right to display such content on the platform and partner sites.
Media provided for promotional purposes may be used by Famez.com to advertise the creator or agency.
Famez.com is not liable for copyright infringements committed by third parties.
Users must ensure that all persons depicted have given written consent to publication.
Famez.com reserves the right to request proof of such consent at any time.

12. Withdrawal & Refund Policy

Famez.com is intended exclusively for commercial users (B2B).
Therefore, consumer withdrawal rights do not apply.
Once service provision has begun (e.g., campaign publication, ad placement, or promotion launch), cancellation or refund is excluded.
A service is considered rendered once Famez.com or a partner has started execution.
Unjustified chargebacks (disputes) are considered breach of contract, and resulting fees will be charged to the user.
Famez.com reserves the right to take legal action in cases of fraud, abuse, or false information.

13. Prohibition of Exploitation & Abuse

Any form of human trafficking, coercion, sexual exploitation, or abuse is strictly prohibited.
Famez.com follows a zero-tolerance policy and will report violations to the competent authorities.
Suspicious content will be automatically and manually reviewed.
Users confirm that all depicted persons are of legal age and have given consent.

14. Amendments to the T&C

Famez.com may modify these T&C at any time. Changes will be communicated to users.
Continued use of the platform after modifications constitutes acceptance of the updated terms.

15. Final Provisions

If any provision of these T&C is found to be invalid, the remaining provisions shall remain in full force and effect.
The applicable law is that of the Republic of Croatia.
Place of jurisdiction: Split, Croatia.
This platform and all related services are intended exclusively for commercial users, agencies, and creators acting within the scope of their professional activities.
