1.2 Scope
These Terms and Conditions govern the use of the Famez.com platform ("Platform") by creators, agencies, and fans. By registering on the Platform, users agree to these Terms in their current version. Any conflicting terms of the user shall not apply unless explicitly agreed to in writing by Famez.com.
1.3 Contract Language and Governing Law
The contract language is English. These Terms are governed by the laws of the Republic of Croatia. Consumer protection laws shall only apply if the user qualifies as a consumer under applicable law.
1.4 Changes to the Terms
Famez.com reserves the right to modify these Terms at any time. Users will be informed of any changes. If no objection is made within 14 days, the updated Terms shall be deemed accepted.
2. Description of Services
Famez.com is a networking and promotional platform for creators and agencies. The sale of digital or physical products, services, or subscriptions via Famez.com is strictly prohibited. Creators may create profiles, interact with fans, run advertisements, and build their reach. Agencies may manage creator profiles and campaigns with the creator’s consent. Famez.com provides only the technical infrastructure and is not a contractual party between users. The platform is generally free but may include paid features. Famez.com may display automatically generated profiles of publicly listed creators, which can be claimed or removed at any time.
3. Registration and Accounts
Registration is permitted only for individuals aged 18 or older. Creators must provide stage name, biography, and engagement links. Agencies must provide company information and managed creators. Login credentials must be kept confidential and not shared with third parties.
4. Creator Profiles and Agency Management
Creators may upload content in compliance with platform guidelines. Sales via Famez.com are prohibited. Agencies may only manage profiles with explicit creator consent. Famez.com reserves the right to remove profiles or content at any time.
5. Advertising and Promotion
Creators may promote their profiles through paid advertising. All ads are subject to approval by Famez.com. Payments are processed via external providers (e.g., Stripe, PayPal). Ads are published only after payment is received. Famez.com may use provided media for promotional purposes across its network.
6. Prohibition of Direct Sales
Direct sales via Famez.com are prohibited. Creators may use the platform for promotional purposes only. Agencies may not sell services directly to fans. Violations may result in account suspension or deletion.
7. User Responsibilities
Users are responsible for their content. Spam, fraud, or illegal activity will result in immediate suspension. Agencies may only manage verified creators.
8. Disclaimer of Liability
Famez.com is not liable for technical issues, data loss, or inaccurate user information. Famez.com only provides infrastructure; agreements between users are their own responsibility.
9. Termination
Users may delete their accounts at any time. Famez.com may suspend accounts for violations. No refunds will be issued for paid services.
10. Data Protection
Famez.com processes personal data in accordance with applicable laws. Data will not be shared with unauthorized third parties.
11. Intellectual Property
All content remains the property of the uploader. Users grant Famez.com a license to display content. Users must ensure all depicted persons have given consent.
12. Refund Policy
Famez.com operates on a B2B basis. No right of withdrawal applies. All purchases are final once services begin.
13. Prohibited Conduct
Any form of exploitation, trafficking, or abuse is strictly prohibited. Violations will be reported to authorities.
14. Use of the FAMEZ CRM
Famez provides a web-based CRM system for creators and agencies.

Famez acts solely as a technical provider.
15. External Platform Integration
The CRM integrates with external platforms (e.g., OnlyFans, F2F, Fansyme). Users are responsible for compliance with those platforms.
16. Third-Party Liability
Famez is not liable for bans, API changes, or revenue losses.
17. Security and Access
Users are responsible for safeguarding credentials.
18. Agency and Staff Access
Creators may grant access to agencies or staff at their own risk.
19. Communication Responsibility
All communication is the responsibility of the creator.
20. Automation
Automated actions may occur via the CRM and are considered user actions.
21. No Payment Processing
Famez does not process payments between users.
22. Availability
Continuous availability is not guaranteed.
23. Data Storage
Data is processed and stored as part of CRM usage.
24. Content Responsibility
Users are responsible for legality of content.
25. Abuse and Suspension
Famez may suspend accounts for violations.
26. No Guarantee of Success
Famez does not guarantee any results.
27. Unauthorized Access and Security Violations
Unauthorized access, hacking, or manipulation is strictly prohibited.
28. Enforcement Actions
Famez may take legal action and suspend accounts.
29. Cooperation in Security Incidents
Users must report vulnerabilities and cooperate.
30. User Liability
Users are liable for damages caused by misuse.
31. Amendments
Famez may update these Terms at any time.
32. Final Provisions
